My husband has large debts, do companies need my information?

hi,
My husband has recently sought advise about his debt through the CAB.
They have asked for my details income etc.
do they need this? as none of the debt is in my name and most of it was generated before we met.
we are not linked financially all bills are under my name, and the house is under his name.
i am unwilling and unable to pay towards his debt do i have to?

No, you are not resposible for your husbands debts and you cannot be pursued for them.
However, there is a complication here in that the house you are living in belongs (you say) to your husband. If so, you are In effect deriving benefit from an asset of your husband. It may well be that your financial position will be considered relevent because of this.
You should seek independent advice from the CAB.

  • CAB will be trying to help your husband - they will need to have a full insight into the household finances to best advise him. Do you have a joint bank account - this is enough for your finances to be linked. If it comes to Bankruptcy then you will find it difficult to hold onto anything unless you have really solid proof that any assets were held by you before marriage - even then you will lose your home as its in his name. Why are you so unwilling to help? Did he hide his financial situation from you when you got married? If you want to help go & talk to CAB on your own - they should be able to explain everything to you.

  • The CAB will help him budget and pay his debts in small amounts. They wont help him try to get his debts legally cancelled altogether. Try www.bdebtfree.info for help with this.
